Sheriff’s Deputy Facing Prison Time For False Worker’s Compensation Claims.

Worker’s compensation claims are available to employees to assure that if the employee is ever injured, the employee or his or her family, will be able to take care of themselves. However, as with most things in life, there are those people who would rather attempt to cheat the system than play by the rules and file false/fraudulent claims for an easy buck. This means that rather than being an easy process to complete, filing a worker’s compensation claim can be complicated. That is why if you or a loved one are injured on the job, you should turn to an experienced workers compensation claim attorney at our Boston, Massachusetts law firm for help.

An arraignment is scheduled this week for a San Diego County, California sheriff’s deputy who allegedly scammed insurers out of tens of thousands of dollars by filing bogus workers’ compensation claims. Matthew Tobolsky, 40 years-old, faces eight counts of insurance fraud, two counts of filing a false claim, three counts of attempted perjury, and one count of failing to disclose information that affects a payment, according to the local District Attorney’s Office. If convicted on all counts, he could be in line for a maximum sentence of 15 years in prison.

After claiming a back injury from lifting five-gallon water bottles eight months ago, Deputy Tobolsky allegedly misrepresented his physical condition and abilities repeatedly, working out with heavy weights at a gym while telling physicians he was suffering from debilitating pain and unable to perform even light duty, according to prosecutors. His alleged crimes resulted in $57,000 worth of insurance losses, $46,000 of which was paid directly to him. It is estimated that these types of fraud cases cost Californians roughly $4 billion annually.
