Marty Magid, the sports agent recently fired by Pro Bowl defensive end Elvis Dumervil of the Denver Broncos, has hired Attorney David Cornwell to represent him. This was after Magid’s late submission of his former client’s contract with the Denver Broncos led to Dumervil’s release.
Magid has most likely hired Cornwell as a preemptive measure in the event that he faces any litigation from Dumervil, or the Denver Broncos, or any disciplinary proceedings by the National Football League Players Association.
According to reports, Dumervil was released by the Broncos just before the 4 p.m. Friday deadline, when his restructured contract had to be submitted. Dumervil had agreed to reduce his 2013 salary from $12 million to $8 million in an effort to alleviate salary cap pressures on the Broncos.
After the final contract arrived seven minutes late, the Broncos elected to release Dumervil, rather than absorb the salary cap pressure that the player’s un-reduced $12 million salary would bring.
Dumervil and his agent had previously agreed with the Broncos chief negotiator, Mike Sullivan, to cut Dumervil’s salary by $4 million. While rewrites and tweaks to the language of the contract,regarding the second year of the deal, ran close to the deadline, Dumervil did not receive the document until a mere few minutes before the contract deadline.
Though Dumervil says he faxed the signed contract ahead of the deadline, the Broncos did not receive the fax in time, and consequently released Dumervil, who is now a free agent.
Dumervil proceeded to fire Magid the next day, after the deadline miss, and hire a new agent. That agent is now handling his contract negotiations with a number of teams, including the Broncos.
The NFL Players Association is currently reviewing Magid’s actions. It is unclear whether Magid will face any litigation or disciplinary action stemming from this dispute.
