Truck Driver’s Fraud Revealed In Workers’ Compensation Lawsuit.

On its face, workers’ compensation seems like a well-designed system that is mutually beneficial to the employee and the employer. Workers just want to be fairly compensated for injuries suffered while on the job, and both workers and employers would seem to prefer such a system to avoid the litigation process. Unfortunately, as with any lawful system, there are those who would not hesitate to take advantage, either through loopholes or even lies. In such a situation, it would be wise to contact an expert workers’ compensation attorney at 617-787-3700.

In 2004, Roger Decker, a truck driver employed by Lee Center in Utica, New York, was injured on the job. Soon after, he began collecting workers’ compensation benefits for his injuries. Over the course of the next ten years, Decker would go on to get jobs with several other truck driving companies, and appears to have worked steadily over that period of time. However, in the benefit paperwork he filed in 2016, Decker claimed he had not worked for the past 10 years in an effort to get increased benefits.

After being exposed for his misrepresentations, Decker recently pleaded guilty in Utica City court to one count of third-degree perjury. In addition to lying on his benefits sheets, Decker also allegedly testified at a  Workers’ Compensation Board hearing that he had been out of work for an extended period of time. In 2016, Decker received a total of over $7,000 in workers’ comp benefits.

New Proposal Could Cut Workers’ Compensation Rates In Florida Significantly.

Workplace injuries have been occurring for as long as workplaces have existed, and the law has been constantly changing to account for the potential remedies workers may be entitled to in the event of such injuries. The law varies from state to state, but it is crucial for workers to understand their options in the event of an injury so that they can be fairly compensated. In such a situation, it would be wise to contact an expert worker’s compensation attorney at 617-787-3700.

Workers in Florida might want to keep an eye on the news, as a recent proposal by the National Council on Compensation Insurance calls for a 13.4% rate decrease for workers’ compensation claims starting in January. The Florida Office of Insurance Regulation will review the details of the proposal and decide whether to approve the cut or request changes. But if approved, the reduction would follow a 9.5 percent decrease that already took effect this year.

Some hail this move as a win for small business in Florida. With lower expenses in workers’ compensation coverage, small business will have more room for growth. Levels of optimism are high surrounding small businesses at the moment, which could lead to greater investment, according to executive director of the National Federation of Independent Business in Florida, Bill Herrle. A public hearing on the proposed cuts will be held in October.

New Reports Indicate That Workers’ Compensation Is Often Denied To Texas Firefighters With Cancer.

Workers’ compensation systems are a two-way street that attempt to give some peace of mind to both the employer and the employee. The employee receives some assurance that the medical costs for any injury he receives in the course of his employment will be covered, while the employer receives some assurance that the employee will not sue the employer in tort for the injury. The system is not foolproof, however, and both the employer and the employee can engage in behavior designed to circumvent or take advantage of the system. In such a situation, it would be wise to contact an expert workers’ compensation attorney at 617-787-3700.

According to Texas state union leaders and state lawmakers, Texas cities are systematically denying workers’ compensation to firefighters who have cancer. According to the Texas Department of Insurance, over 90% of the workers’ comp claims over the past 6 years made by firefighters with cancer have been denied. Although nearly 65% of these denials are overturned on appeal, firefighters rarely choose to deal with the administrative process and hardship of appealing the denial of a claim.

This is especially controversial considering there is a Texas state law that requires the government to presume that firefighters’ cancer is the result of exposure to deadly carcinogens while on the job. However, city officials have allegedly been using an official memo that narrows the state law to 3 specific types of cancer. According to union leaders, this memo flies in the face of scientific research linking firefighting to a wide variety of cancers.
